Terms of Service

These Terms of Service (“Terms”) govern your use of Vitex, the protocol-tracking application and website at vitexapp.com (the “Service”), operated by Vitex (“we,” “us”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Not medical advice — read this first

Vitex is an informational and personal tracking tool. It is not a medical device, and nothing in the Service — including AI-generated analysis, scores, optimization suggestions, interaction alerts, chat responses, tips, or cited sources — constitutes medical advice, diagnosis, or treatment. No doctor–patient relationship is created by using Vitex. Always consult a qualified healthcare professional before starting, stopping, or changing any supplement, medication, peptide, or health protocol, and never disregard professional advice because of something you saw in Vitex. If you think you may have a medical emergency, call your local emergency number immediately.

2. Eligibility and your account

  • You must be at least 18 years old to use Vitex.
  • Provide accurate information and keep your login credentials secure; you are responsible for activity under your account.
  • One account per person. Notify us promptly of any unauthorized use.

3. The Service and your content

You own your data. The protocol, health, and other information you enter remains yours. You grant us a limited license to host, process, and display it solely to operate and improve the Service as described in the Privacy Policy. You are responsible for the accuracy of what you enter and for anything you choose to share via share links, which are visible to anyone holding the link until you revoke them.

4. AI features

  • AI outputs are generated automatically and may be incorrect, incomplete, or outdated, even when accompanied by citations. Verify anything important with the cited sources and your healthcare provider.
  • AI features may be limited (for example, daily message caps) and depend on third-party providers whose availability we don’t control.
  • You may not use the AI features to generate advice for third parties or represent outputs as professional medical guidance.

5. Plans, billing, and trials

  • Free plan: core tracking with limits (currently up to 15 protocol items), plus a 7-day trial of AI features for new accounts.
  • Pro subscription: billed monthly or annually via Stripe at the price shown at checkout, in U.S. dollars. Prices may change; changes apply to new billing periods after notice, never retroactively.
  • Auto-renewal: subscriptions renew automatically until cancelled. Cancel anytime via Account Settings → Manage billing; cancellation takes effect at the end of the current billing period, and you keep Pro access until then.
  • Refunds: except where required by law, payments are non-refundable and we do not prorate partial periods. If something went wrong, contact us — we’re reasonable.
  • Taxes may apply depending on your location.

6. Marketplace and third-party links

The marketplace lists third-party products with links to external retailers. We may earn an affiliate commission when you purchase through those links, at no extra cost to you. We are not the seller, make no warranties about third-party products, and listing a product is not a claim about its safety or efficacy. Your purchases from third parties are governed by their terms.

7. Acceptable use

  • No unlawful use, no attempting to breach security or access other users’ data, no scraping or bulk extraction, no reverse engineering, and no reselling the Service.
  • No circumventing plan limits, rate limits, or feature gates.
  • No uploading content you don’t have the right to share, or that is malicious or harmful.

8. Intellectual property

The Service — including its software, design, and the Vitex name and brand — is owned by us or our licensors and protected by law. These Terms grant you a personal, non-exclusive, non-transferable right to use the Service; they transfer no ownership.

9. Termination

You can stop using Vitex and delete your account at any time in Account Settings (this permanently erases your data). We may suspend or terminate accounts that violate these Terms, create risk for other users, or are required to be terminated by law; where practical we will give you notice and a chance to export your data.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUTS OR REMINDERS WILL BE ACCURATE OR TIMELY. YOU USE THE SERVICE AT YOUR OWN RISK.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE — INCLUDING DECISIONS YOU MAKE BASED ON INFORMATION OR AI OUTPUTS IN THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE (OR USD $50 IF YOU HAVE PAID NOTHING). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify us against claims arising from your violation of these Terms, your misuse of the Service, or content you share through it.

13. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Courts located in Ontario have exclusive jurisdiction, except where the law of your place of residence grants you non-waivable rights or venue.

14. Changes to these Terms

We may update these Terms as the Service evolves. For material changes we will notify you in the app or by email before they take effect; continued use after the effective date constitutes acceptance. The date at the top reflects the latest revision.
